Jury To Decide Secrets Spat Between Doctor, Mayo

Law360, New York (March 5, 2010, 5:03 PM EST) -- The Mayo Clinic and a former doctor at the world-renowned medical facility have both been denied summary judgment bids in a suit claiming that the ex-employee delivered trade secrets to Merck & Co. Inc. related to natural language processing software.

Judge David S. Doty of the U.S. District Court for the District of Minnesota largely denied summary judgment to Mayo and Dr. Peter L. Elkin on Thursday, saying that a jury must decide most of the dispute.
