E.U. Court Rejects Adidas Trademark Claim

Law360, New York (October 24, 2003, 12:00 AM EDT) -- The European Court of Justice rejected Adidas Salomon AG's claim that the use of a two-stripe design by Netherlands-based Fitnessworld Trading Ltd. infringes on Adidas' trademark, the Associated Press reported.

"The proprietor of a trademark with a reputation cannot prevent the use of a similar sign viewed purely as a decorative motif," the judges said in their ruling.

However, they added that companies such as Adidas could argue a trademark violation if the public "establishes a link" between their trademark and a similar sign.
