Law360, New York (March 10, 2010, 7:29 PM EST) -- An appeals court elected Wednesday to vacate a previous opinion and rehear a case brought against Home Depot USA Inc. by two men who claimed a male human resources manager's advances created a hostile work environment, less than a week after a law professor asked the U.S. Supreme Court to take up the case.
The U.S. Court of Appeals for the Eleventh Circuit issued an order saying the case would be reheard en banc. The court had previously affirmed a dismissal of the suit.
