Ball Bearing Co.'s Claims Fall Outside CIT Scope: US

Law360, New York (March 11, 2010, 5:23 PM EST) -- The U.S. government has moved to dismiss allegations made by a Japanese ball bearings importer that liquidation instructions issued to U.S. Customs and Border Protection fell outside of the agency's authority.

The government filed a motion Wednesday in the U.S. Court of International Trade, arguing that the claims — added in February to a complaint brought by Shinyei Corp. of America — fall outside of the court's jurisdiction and should therefore be dismissed.
