Polish Telecom Loses Tying Battle In EU Court

Law360, New York (March 11, 2010, 4:01 PM EST) -- The European Union's highest court has shot down Telekomunikacja Polska SA's challenge to a Polish law prohibiting telecommunications providers from forcing consumers to purchase multiple services.

The Court of Justice of the European Union ruled Thursday that while national legislation prohibiting any combined offer was incompatible with EU law, member states had the authority to block providers from making service contracts contingent on consumers agreeing to separate contracts.
