Cablevision, Comcast Lose Challenge To FCC Rule

Law360, New York (March 12, 2010, 3:15 PM EST) -- A federal appeals court has rejected a challenge from Cablevision Systems Corp. and Comcast Corp. to a Federal Communications Commission decision to extend a rule that prevents cable operators from withholding programming from rivals.

In a 2-1 decision Friday, the U.S. Court of Appeals for the District of Columbia Circuit said that although the market for multichannel video programming has become less concentrated, cable operators still have two-thirds of the market, which supports the FCC's decision to continue the ban.
