Butterball Turkey Plant Donning, Doffing Action Tossed

Law360, New York (March 17, 2010, 2:51 PM EDT) -- A federal judge has thrown out a putative class and collective action over Butterball LLC's policy of not paying turkey processing plant workers for donning and doffing protective gear, finding that the plaintiffs' union had acquiesced to the policy.

Judge Marcia Krieger of the U.S. District Court for the District of Colorado signed off on an order Monday adopting a magistrate judge's recommendation and granting Butterball's bid for summary judgment.
