Sippy Cup Trademark Spat Against Walgreen Survives

Law360, New York (March 22, 2010, 7:08 PM EDT) -- A federal judge has tossed one of four causes of action asserted by Luv n' Care Ltd. and Admar International Inc. in a trade dress suit against Walgreen Co. over children's sippy cups, but left trademark and unfair competition claims standing.

Judge Denny Chin of the U.S. District Court for the Southern District of New York ruled on dueling motions for summary judgment Friday, rejecting the plaintiffs' summary judgment bid in its entirety and tossing a claim under the New York General Business law.
