Judge Rules For Andrx In Bristol-Myers Patent Suit Over Monopril

Law360, New York (June 7, 2004, 12:00 AM EDT) -- Andrx Corp. does not infringe a patent that Bristol-Myers Squibb Co. holds for its Monopril hypertension drug, a federal judge has ruled in a decision that clears the way for Andrx to sell generic version of the product.

Bristol-Myers' lawsuit was not "based on scientifically sound principles" or justifiable patent claims, U.S. District Judge Paul Huck wrote in a 52-page order after hearing the trial without a jury last month.
