2nd Circ. Says Judge's Google Search Allowed

Law360, New York (March 23, 2010, 2:35 PM EDT) -- The U.S. Court of Appeals for the Second Circuit has let Judge Denny Chin off the hook for conducting a Google search to double-check a hunch in the case of a man convicted of a bank robbery.

Judge Chin, who handed down Ponzi schemer Bernard L. Madoff's 150-year prison sentence and other high-profile rulings, did not violate federal evidence rules when he used Google Inc.'s search engine to “confirm his intuition regarding a matter of common knowledge,” the Second Circuit concluded Monday.
