Farmworkers Lose Bid To Upend H-2A Wage Rules

Law360, New York (March 24, 2010, 5:14 PM EDT) -- A federal judge has rejected a bid by two farmworkers unions for partial summary judgment on their challenge to the data the U.S. Department of Labor used to calculate farmworker wages under the revamped H-2A guest worker visa program.

Judge Ricardo M. Urbina of the U.S. District Court for the District of Columbia on Monday denied the plaintiffs' motion for partial summary judgment on their claim that H-2A's wage rate provisions violated the Administrative Procedure Act.
