Suit Filed Over Plan To Close New York Hospitals

Law360, New York (January 3, 2007, 12:00 AM EST) -- A lawsuit was filed Wednesday to try stop the closure of hospitals in New York, alleging the state violated the Constitution by allowing appointed members of a commission to make sweeping changes in health care policy.

The suit, filed by New York Lawyers for the Public Interest and the law firm of Chadbourne & Parke LLP on Wednesday, asks the court to declare the enabling legislation unconstitutional and to permanently enjoin the state commissioner of health from implementing the downsizing and closures of 57 hospitals around...
