UPS Store Franchisees Take Contract Suit To 9th Circ.

Law360, New York (March 25, 2010, 12:47 PM EDT) -- More than 200 franchisees of The UPS Store have appealed a lower court loss in their suit alleging UPS Inc. and subsidiary Mail Boxes Etc. Inc. duped investors into opening franchises that are consistently unprofitable.

The U.S. Court of Appeals for the Ninth Circuit acknowledged receipt of the appeal Wednesday, and gave the appellants until Aug. 30 to file an opening brief contesting the lower court’s March order granting final judgment for the defendants, which stand accused of breaching their franchise agreements and defrauding franchisees....
