Mid-Continent Insured Didn't Breach Pact: 11th Circ.

Law360, New York (March 30, 2010, 3:43 PM EDT) -- A federal appeals court has reversed a ruling that a defunct Florida homebuilder breached the terms of its $1 million general liability policy with insurer Mid-Continent Casualty Co. in an indemnity fight over a $1.7 million settlement in an underlying copyright case.

The ruling on Monday in the U.S. Court of Appeals for the Eleventh Circuit reversed the lower court, which ruled that American Pride Building Co. LLC breached its duty to cooperate by entering into a settlement without the blessing of the insurer.
