Andrx To Pay $6M To Settle Kos Trademark Suit

Law360, New York (June 10, 2004, 12:00 AM EDT) -- Andrx Corp. will pay Kos Pharmaceuticals $6 million and agree to stop using the Altocor trademark for any of its products under a settlement agreement between the two companies.

Kos said the payment and promise settle a trademark infringement lawsuit and should avoid further confusion between Andrx's cholesterol product, Altocor, and Kos' cholesterol product, Advicor.

Last month, an appeals court ordered a lower court to grant Kos Pharmaceuticals’ request for an injunction against Andrx’s use of the brand name "Altocor" in order to prevent consumer confusion...
