La. Health Insurance Law Unconstitutional: 5th Circ.

Law360, New York (April 1, 2010, 1:03 PM EDT) -- A federal appeals court has ruled that a Louisiana law that effectively favors Louisiana insurance companies in bidding for health insurance coverage for state employees violates the U.S. Constitution.

The U.S. Court of Appeals for the Fifth Circuit issued its 2-1 ruling Wednesday, coming to the same conclusion as a lower court but for different reasons. As a result, the appeals court lifted a permanent injunction issued by the district court against the law and remanded the case for further proceedings.
