Aspex Seeks Injunction In Antitrust Suit Against Insurer

Law360, New York (April 12, 2010, 3:44 PM EDT) -- Eyeglass maker Aspex Eyewear Inc. is seeking a preliminary injunction in its antitrust and false advertising suit against eye care insurer Vision Service Plan, which claims the insurer has been using threats and unfair practices that could put the company out of business.

Vision and two subsidiaries, Altair Eyewear Inc. and Marchon Eyewear Inc., allegedly used Vision's “monopoly power in the eye care insurance market as a weapon to coerce Aspex into surrendering its valuable patent rights,” according to the motion, filed Friday in the U.S....
