3rd Circ. Vacates Carpenter's $11M CERCLA Debt

Law360, New York (April 12, 2010, 6:54 PM EDT) -- A federal appeals court has vacated a district court judgment ordering specialty alloys maker Carpenter Technology Corp. to pay $11 million in cleanup costs incurred by Ford Motor Co. and four other plaintiffs at a Superfund site in Pennsylvania.

Finding that the lower court reached its judgment by way of inadmissible evidence, a three-judge panel in the U.S. Court of Appeals for the Third Circuit ruled Monday that the case should return to the U.S. District Court for the Eastern District of Pennsylvania for further deliberation....
