CORRECTED: Unenforceability Verdict Sticks In Target Stroller Patent Spat

Law360, New York (April 13, 2010, 6:40 PM EDT) -- An inventor who sued Target Corp. over its sale of Baby Trend Inc. strollers that allegedly infringe a patent has failed to convince a judge to reject a jury’s finding that the patent is unenforceable because of information withheld from the U.S. Patent and Trademark Office during the application process.

Judge Royal Furgeson of the U.S. District Court for the Northern District of Texas on Thursday essentially affirmed a jury’s January verdict, which found that inventor Albert T. Fairclough’s patent was uneforceable due to inequitable conduct....
