Counselors Hit University Of Phoenix With OT Action

Law360, New York (April 13, 2010, 1:21 PM EDT) -- A University of Phoenix Inc. enrollment counselor has made a bid for collective certification in her case alleging that, through the use of a dual bookkeeping system, the Web-based school underpaid counselors for overtime hours worked.

Lead plaintiff Diane Adoma asked for conditional certification of a Fair Labor Standards Act collective action for all University of Phoenix hourly employees who worked as enrollment counselors within California in the past three years in the U.S. District Court for the Eastern District of California on Monday.
