Case Over GE's Omniscan Survives Dismissal Bid

Law360, New York (April 14, 2010, 2:18 PM EDT) -- A New York state judge has largely preserved a kidney disease patient's lawsuit against General Electric Co. and affiliates over health problems allegedly caused by her exposure to a gadolinium-based contrast agent, Omniscan, in imaging procedures.

Judge Doris Ling-Cohan of the Supreme Court of the State of New York in New York County on Monday declined to dismiss claims including strict product liability, negligence, fraud and misrepresentation and a derivative claim brought by the patient’s parents for medical expenses.
