New Trial Ordered In BP Water Flow Negligence Suit

Law360, New York (April 19, 2010, 6:20 PM EDT) -- A Texas appeals court has ordered a new trial for Discovery Operating Inc. in its lawsuit accusing BP America Production Co. of causing a highly pressurized water flow that prevented it from drilling an oil well.

The Eleventh Court of Appeals of Texas reversed judgments for BP on Thursday after finding that the trial court had made erroneous summary judgment and evidentiary rulings that harmed Discovery in the presentation of its case.
