Shell Union Spat Must Remain In Federal Court: 9th Circ.

Law360, New York (April 22, 2010, 2:32 PM EDT) -- A federal appeals court has ruled that a lower court's denial of class certification does not strip an employment dispute of federal jurisdiction, in a union's suit alleging that Shell Oil Co. and Tesoro Refining and Marketing Co. did not provide workers meal and rest breaks at their refineries.

The U.S. Court of Appeals for the Ninth Circuit on Wednesday reversed the district court's decision that the suit should be remanded to state court because class certification was denied.
