2nd Circ. Revives Bike Injury Suit Against Trek

Law360, New York (April 26, 2010, 4:23 PM EDT) -- An appeals court has vacated a prior order letting Trek Bicycle Corp. off the hook in a suit brought by a man who sustained shoulder injuries because of an alleged manufacturing defect in the bike he was riding.

The U.S. Court of Appeals for the Second Circuit ruled Thursday that the district judge correctly excluded plaintiff Jerry Lynch’s expert testimony in a Daubert hearing but wrongly granted judgment as a matter of law in favor of the defendant.
