Arbitration Awards Not Always Final: Calif. High Court

Law360, New York (April 26, 2010, 6:53 PM EDT) -- The California Supreme Court ruled Monday that courts can overturn arbitration awards if an arbitrator makes a clear error of law that denies an employee a hearing on the merits of a discrimination or harassment claim.

In the 4-3 decision, written by Justice Carlos R. Moreno, the court ruled that allowing an arbitrator's incorrect decision to dismiss an employee's claim for reasons unrelated to the merits of the claim to stand would deprive the employee of his statutory rights.
