Avid's Pet ID Patent Not Enforceable: Fed. Circ.

Law360, New York (April 28, 2010, 5:12 PM EDT) -- A federal appeals court has upheld a lower court's determination that an Avid Identification Systems Corp. patent covering technology for identifying lost pets is unenforceable due to inequitable conduct.

The U.S. Court of Appeals for the Federal Circuit on Tuesday ruled that Avid-held U.S. Patent Number 5,235,326 was unenforceable because the company's founder had failed to disclose prior art to the U.S. Patent and Trademark Office.
