Appeals Court Remands Electric Rate Case To FERC

Law360 (January 16, 2007, 12:00 AM EST) -- A federal appeals court on Friday vacated a Federal Energy Regulatory Commission decision regarding a rate dispute between a New York City energy provider and an energy system operator, remanding the case to FERC for a new hearing.

Electric power company Keyspan-Ravenswood LLC filed a complaint with FERC against the New York Independent System Operator in 2004, claiming that the New York City energy operator violated the Federal Power Act by changing rate requirements without proper notice.
