Korea's Hyosung Corp. Fights Steel Plate Duty In CIT

Law360, New York (April 28, 2010, 3:02 PM EDT) -- An apparent filing mistake has led Hyosung Corp. challenge the federal government's preliminary finding that the Korean exporter should be slapped with a steep 32.70 percent duty on cut-to-length carbon-quality steel plate.

The Seoul-based company's partially redacted complaint, lodged Tuesday in the U.S. Court of International Trade, claims the U.S. Department of Commerce abused its discretion when it applied a so-called adverse facts available rate on the company after rejecting several relevant filings.
