Supreme Court Refuses To Hear IBM Pension Case

Law360 (January 16, 2007, 12:00 AM EST) -- The U.S. Supreme Court refused Tuesday to consider a closely watched lawsuit over IBM’s cash-balance pension plan, meaning that a lower court ruling that the plan doesn’t discriminate against older workers will stand.

In September, the U.S. Court of Appeals for the Seventh Circuit denied a petition en banc in the class action, which had asked all 11 active judges on the bench to review an opinion by three of the appellate court judges saying that International Business Machine Corp.’s plan didn’t discriminate.
