Appeals Court Reawakens Vioxx Testing Campaign

Law360, New York (January 16, 2007, 12:00 AM EST) -- Threatening to usher in a new wave of Vioxx lawsuits, a New Jersey appeals court has revived a proposed class action that seeks to force the pharmaceutical giant to cover medical-surveillance tests for individuals who took the controversial painkiller but have yet to suffer from any health problems.

On Tuesday, the appellate division of the Supreme Court of New Jersey overturned a 2005 lower court decision dismissing the case, shooting the matter back down to the trial judge for further proceedings.
