Toho Tenax Wants Cytec's Price-Fixing Claims Axed

Law360, New York (May 3, 2010, 2:52 PM EDT) -- Carbon fiber manufacturer Toho Tenax Co. Ltd. and a subsidiary have asked a federal judge to dismiss price-fixing claims brought by direct purchaser Cytec Engineered Materials Inc., arguing that the accusations are time-barred.

Toho Tenax argued in a motion filed Friday in the U.S. District Court for the Central District of California that the four-year statute of limitations had run out on Cytec's claims, both because the alleged misconduct ended in 1999 and because Cytec terminated a tolling agreement with Toho Tenax, in which participants agreed...
