AmEx Antitrust Case Remanded After Stolt-Nielsen

Law360, New York (May 3, 2010, 1:49 PM EDT) -- The U.S. Supreme Court has sent a suit over the role of arbitration in a group of merchants' antitrust suit against American Express Co. back to a circuit court in light of its ruling last week in Stolt-Nielsen SA v. Animalfeeds International Corp.

In an order list published Monday, the Supreme Court granted AmEx's petition for writ of certiorari and vacated the judgment of the U.S. Court of Appeals for the Second Circuit, which had found that arbitration provisions in AmEx's contracts with the merchants didn't...
