High Court Denies Cert To JPMorgan In FLSA Suit

Law360, New York (May 3, 2010, 12:33 PM EDT) -- The U.S. Supreme Court on Monday declined JPMorgan Chase & Co.'s petition to hear a case challenging the bank’s classification of its loan underwriters as exempt from federal overtime requirements.

The high court denied JPMorgan's petition for certiorari, which the bank filed after the U.S. Court of Appeals for the Second Circuit ruled that former underwriter Andrew Whalen did not fall under the Fair Labor Standards Act’s administrative exemption, reversing a trial court win for JPMorgan.

JPMorgan filed the petition March 22.
