Trial Court Misread Vulcan's Policy: Appeals Court

Law360, New York (May 4, 2010, 3:23 PM EDT) -- A California appeals court has directed a trial court to vacate and reissue a pretrial order in Transport Insurance Co.'s declaratory judgment suit against chemical company Legacy Vulcan Corp. over coverage in an environmental cleanup case, finding that the trial court improperly interpreted Transport's umbrella coverage obligations under the policy.

The Court of Appeal of the State of California for the Second Appellate District on Friday issued an order granting chemical manufacturer Vulcan's writ of mandate challenging the pretrial order.
