Claims Trimmed In Pom False Ad Suit Against Coke

Law360, New York (May 6, 2010, 3:52 PM EDT) -- A Pom Wonderful LLC suit accusing The Coca-Cola Co. of misleading consumers with its blueberry-pomegranate labeled juice has survived a bid for summary judgment, though several claims are now off the table.

Pom will be allowed to argue that Coke's advertising tricked consumers, but it cannot take issue with Coke's labeling or name for the drink — two areas under the authority of the U.S. Food and Drug Administration, Judge S.
