Dismissal Of Katrina Coverage Class Action Affirmed

Law360, New York (May 6, 2010, 3:34 PM EDT) -- A federal appeals court has affirmed the dismissal of a putative class action alleging that Lexington Insurance Co.'s homeowners insurance policies covered damage caused by Hurricane Katrina.

In an unpublished, per curiam opinion released Tuesday, the U.S. Court of Appeals for the Fifth Circuit affirmed a lower court's decision to toss a putative class action accusing the insurance company of violating Louisiana’s Valued Policy Law, as well as the state's insurance bad faith statutes.
