Zuckerman's Fraud Claims Against Merkin Still Alive

Law360, New York (May 10, 2010, 1:52 PM EDT) -- A New York state judge has allowed real estate and media mogul Mortimer Zuckerman's fraud claims against J. Ezra Merkin, manager of one of the largest funds feeding cash to Bernard L. Madoff's Ponzi scheme, to survive, but dismissed Zuckerman's misrepresentation claims.

Judge Richard Lowe of the New York State Supreme Court on Wednesday also dismissed Zuckerman's fraud, aiding and abetting, and negligent and gross misrepresentation claims against accounting firm BDO Seidman LLP, which audited Merkin's books. The order was made public Friday.
