Costco Experts Nixed In Tylenol Infant Death Case

Law360, New York (May 10, 2010, 1:20 PM EDT) -- A federal judge has thrown out most of the expert testimony defending Costco Wholesale Corp. from allegations that it caused an infant's death by failing to warn of potential dangers when it sold Children's Tylenol cold medicine.

Judge Otis D. Wright II of the U.S. District Court for the Central District of California tossed the testimony Friday, saying the comments were improperly disclosed because the opinions went beyond the expert testimony previously submitted by the plaintiffs.
