TVA CEO To Be Deposed In Coal Ash Case

Law360, New York (May 13, 2010, 3:32 PM EDT) -- The judge overseeing the lawsuits against the Tennessee Valley Authority over a 2008 coal ash sludge spill has given plaintiffs attorneys the green light to depose CEO Tom Kilgore about his knowledge of the dike failure that caused the spill.

Magistrate Judge H. Bruce Guyton of the U.S. District Court for the Eastern District of Tennessee ruled Thursday that Kilgore had unique personal knowledge of events relevant to the case, denying TVA's motion for a protective order to preclude the deposition.
