Plavix Makers Fight For Exclusivity

Law360 (January 22, 2007, 12:00 AM EST) -- Sanofi-Aventis and Bristol-Myers Squibb Co. begged the court to uphold their patent for blood thinning medication Plavix, as a trial over the blockbuster drug got underway Monday.

The trial pits the brand name drug titans against Canada-based generic maker Apotex Inc., which launched an “at-risk” generic version of Plavix on Aug. 8 following the failure of a settlement deal with France-based Sanofi and its U.S. partner Bristol-Myers.

The settlement would have delayed a generic version of the drug from hitting the market until 2011.
