Calif. Plaintiffs Appeal Pay-For-Delay Cipro Case

Law360, New York (May 18, 2010, 4:57 PM EDT) -- Indirect purchasers of Cipro are asking a California appeals court to reverse a lower court's ruling that Bayer AG did not violate California antitrust law when it paid Barr Pharmaceuticals Inc. to delay the entry of a generic version of the antibiotic.

The plaintiffs filed a brief Friday with the California Court of Appeals, Fourth Appellate District, asking the court to reverse the August 2009 decision of Judge Richard E. L. Strauss of the Superior Court of California, County of San Diego.
