Braintree Loses Bid To Toss MiraLax Antitrust Suit

Law360, New York (May 19, 2010, 7:06 PM EDT) -- A federal judge on Wednesday refused to dismiss a class action alleging that Braintree Laboratories Inc., which manufactures constipation drug MiraLax, violated antitrust laws by initiating sham litigation against a company that wanted to make a generic version of the drug.

Judge Sue L. Robinson of the U.S. District Court for the District of Delaware issued the ruling, saying, among other things, that the plaintiffs — Meijer Inc., Rochester Drug Co-operative Inc. and Louisiana Wholesale Drug Co., which bought the drug directly from Braintree — had...
