FTC's Antitrust Case Over Birth Control Continues

Law360, New York (January 24, 2007, 12:00 AM EST) -- A judge on Wednesday denied Barr Pharmaceutical Inc.’s motion to dismiss the Federal Trade Commission’s antitrust case over the sale of birth control pills.

Rejecting Barr’s claims that the suit has been rendered moot, U.S. District Judge Colleen Kollar Kotelly said that even though its alleged contract with Warner Chilcott Ltd. has been dissolved, Barr has yet to prove it will never commit such an act again.
