Deferring To NJDEP, Judge Nixes River Groups' Suit

Law360, New York (May 28, 2010, 2:03 PM EDT) -- A federal judge has killed a suit filed by two advocacy groups seeking to force lead pigment maker NL Industries Inc. and others to remove heavy metals from the Raritan River, abstaining from ruling on the case to avoid interfering with the New Jersey Department of Environmental Protection's policies.
