Qualcomm, Texas Instruments Cheer Patent Suit Ruling

Law360 (July 2, 2004, 12:00 AM EDT) -- Both Qualcomm and Texas Instruments declared victory after a Delaware Court ruled that TI violated an agreement with Qualcomm but that Qualcomm is not entitled to break off the deal.

The Delaware Court of Chancery said it agreed with a motion for summary judgment filed by TI and will find that the company didn't “materially” damage Qualcomm when it breached the cross-licensing deal.

Qualcomm argued it was damaged when TI divulged privileged information about the agreement.
