Phoenix, DeviceVM Settle 'Instant-On' Secrets Spat

Law360, New York (May 28, 2010, 12:21 PM EDT) -- Phoenix Technologies Ltd. has settled its trade secrets and contract suit against DeviceVM Inc., which Phoenix launched after one of its ex-employees allegedly shared proprietary information about “instant-on” software technology.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California approved a joint stipulation of dismissal Thursday, ending the eight-month-old case.

The terms of the settlement are confidential, said David Enzminger of O'Melveny & Myers LLP, an attorney for DeviceVM.
