Federal Circuit Overturns Keyboard Patent Ruling

Law360, New York (July 6, 2004, 12:00 AM EDT) -- The Federal Circuit has reversed and remanded a small California company’s lawsuit against Microsoft Corp. over patents for v-shaped ergonomic computer keyboards, raising questions about the credibility of Microsoft’s witnesses in the district court.

TypeRight Keyboard Corp. of Carlsbad, Calif., sued Microsoft in 1998, claiming that Microsoft's keyboard, which splits the layout of keys into two sections and includes a large wrist rest, infringed two of its own patents.

Microsoft responded by asserting affirmative defenses and counterclaims for non-infringement, invalidity and unenforceability.
