New York Utilities Challenge FERC’s Jurisdiction

Law360, New York (January 26, 2007, 12:00 AM EST) -- In a case that could clarify the line between state and federal utility regulation, a handful of New York power companies have asked the Supreme Court to decide if a so-called monthly netting policy unlawfully extends the jurisdiction of the Federal Energy Regulatory Commission.

If the Supreme Court decides to take the case, it will have to chose between FERC, which is backed by about a dozen independent wholesale generators, and the New York State Public Service Commission, which is backed by the power companies, including...
