Jury Sides With Luminant In Alcoa Power Dispute

Law360, New York (June 7, 2010, 1:53 PM EDT) -- A jury has cleared Luminant Generation Co. LLC of claims brought by Alcoa Inc. that the energy company acted in bad faith and breached a major power supply contract with the aluminum giant, instead finding that Alcoa still owes $10 million to Luminant for pollution control upgrades.

Not only was Luminant not the cause of power outages in 2008, but Alcoa still has not paid its fair share for selective catalytic reduction equipment, a jury in the 20th Judicial District Court of Milam County, Texas ruled...
