Federal Circuit To Revisit Work-Product Question

Law360, New York (January 26, 2007, 12:00 AM EST) -- A federal appeals court has agreed to hear en banc a case that will clarify its recent Echostar ruling by determining how far to extend the waiver of attorney-client privilege when companies cite advice from counsel to dodge willful infringement charges.

In accepting the appeal by Seagate Technology LLC on Jan. 26, the U.S. Court of Appeals for the Federal Circuit said it would address whether the waiver should extend from opinion counsel to trial counsel, as well as how such a waiver might affect work-product...
